The War on Gays




The sentencing of Dharun Ravi for the hateful abuse that may have driven his gay roommate at Rutgers, Tyler Clementi, to commit suicide, or Barack Obama’s public acceptance of gay marriage, prevents many of us from seeing that life for gays, lesbians, bisexuals and transgender people is getting worse—much worse.
No one understands this better than the gay activist and pastor Mel White. White, along with his husband and partner of 30 years, Gary Nixon, founded Soulforce, an organization committed to using nonviolent resistance to end religion-based oppression. White and hundreds of Soulforce volunteers protest outside megachurches that preach hatred and bigotry in the name of religion. White travels to communities where young gays, lesbians, bisexuals or transgender people have committed suicide. He holds memorial services for them in front of the church doors. He accuses the pastors of these churches of murder. His books “Stranger at the Gate: To Be Gay and Christian in America” and “Holy Terror: Lies the Christian Right Tell Us to Deny Gay Equality,” are two of the most important works that examine the innate cruelty and proto-fascism of the Christian right. White, more than perhaps any other preacher in the country, has pulled young men and women back from the brink of despair, from succumbing to the tragic fate of Tyler Clementi. And White is scared.
“What kind of environment creates a Dharun Ravi who would carry out that kind of bullying, as well as a kid like Tyler who would become a victim of that kind of bullying?” White asked when I reached him by phone at his home in Long Beach, Calif. “It is society. At its heart it is the church. The churches should be convicted, not just Ravi. He’s just an extension of the hatred that people feel about this threat, this gay threat. Pope Benedict XVI should be on trial. Richard Land from the Southern Baptists should be on trial. Religious leaders, Protestant and Catholic, should be on trial. They made this happen, but too few Americans make the connection.” 
White applauds President Obama for taking a personal stand for marriage equality. But he also notes that the president’s statement was accompanied by a reiteration that states have the right to determine their own policies toward marriage.
Despite gains by gays in the wider culture, especially in the entertainment industry, and despite the repeal of “don’t ask, don’t tell,” the civil rights of gays, lesbians, bisexuals and transgender people in most states are deteriorating, White said.
“Married gays in the military are miserable,” White said. “They can get married, but they can’t have any of the rights of other married military members, including housing or travel. They can give their lives but they get so little in return.”
“Class difference is at the heart of understanding sexism and homophobia,” White said. “Class difference is based on sexism. It is based on homophobia. It is based on men who want to stay in power. And men who want to stay in power go to church. They sit in the front pews. They are generous, loving and faithful. They give away a tiny little bit to keep these churches going. Which is why I stand with the Occupy movement. At least I know I’m with people who will be on my side.”
White and Nixon left Virginia for California a few weeks ago because the culture, he says, had become increasingly inhospitable to gay couples. In distressed communities across the country there is a correlating rise in intolerance, hate talk and homophobia.
“When I moved to Lynchburg it was a blue city, in spite of Liberty University being there,” White said. “We had an amazing progressive woman, Shannon Valentine, as our state representative. She visited our home. We had a progressive mayor and a progressive City Council. In 2008 everything went to hell. Our new attorney general, Ken Cuccinelli, is crazy. He talks about putting cameras up vaginas [as part of a trans-vaginal ultrasound procedure that would be required by law of all women seeking abortions]. We had so many possibilities until 2008. Then it suddenly ended. Unfortunately, more and more this is reflected across the country. The reversal came with the collapse of our financial system. Suddenly everything blue was seen as costing too much money, including helping the poor. There was a revolt led by Fox News and its allies. It’s difficult to find a restaurant or bar in Lynchburg that isn’t playing Fox News. People quote Fox as though Fox is the arbiter of truth. In fact, Fox is the enemy.”
The long-term unemployment, the collapse of housing prices, the wars in Iraq and Afghanistan and the draconian cuts in social spending have created a climate in which the vulnerable, the different, the marginal—from Muslims to undocumented workers to homosexuals—are blamed for the nation’s decline, White argues. This climate is fueling a culture of hate. Right-wing candidates, channeling the rage and frustration of a beleaguered working and middle class, use marginal and oppressed groups as scapegoats. And, White says, those who disseminate this culture of hate lie about the positions and records of liberal elected officials such as Shannon Valentine.
“The lies against her were heinous,” White said, “but the Christian right is convinced that if you have a call to save the nation you are allowed to lie, because the ends justify the means. Jerry Falwell lied on a regular basis. We lost Shannon Valentine. We lost so much that was good about our state after that election. And this is true almost everywhere.”
The culture of hate feeds off the frustrations and feelings of betrayal among the impoverished, the unemployed, the underemployed and the hopeless. And the longer the expanding underclass is ignored, the longer we refuse to define what is happening to us in our corporate state as a vicious class struggle, the more the culture of hate spreads. The dwindling culture of tolerance, confined now mostly to white, urban, college-educated members of the middle class, because that group refuses to engage in the struggle of class warfare, unwittingly abets the economic dislocation that is empowering the increasingly potent culture of hate.
“Progressives ought to move out of New York immediately,” White went on. “Gay people should evacuate the major cities to see what life is like for gays in rural areas. The urban centers of the gay community are too isolated from wider reality. Many in these [urban] communities do not seem to care about reality. Gay people can survive, unfortunately, without paying attention to reality, especially if we’re white and male. If you’re white and male you often can pass.”
“You see Ellen DeGeneres, the most popular talk show, or you see Queen Latifah leading this week’s gay pride parade [May 20] in Long Beach, and you think all is well,” White said. “But you have to remember that in the local Baptist church, or among any of the 15 million Southern Baptist congregants, people see Ellen and Queen Latifah as a threat to family values. What we count as a forward step, they count as evil. They see it as more gay people getting power. We may watch the same television programs. But while we cheer the presence of an openly gay woman or man on television there are large numbers of people in Virginia and other states who see these public affirmations as another step towards the country’s oblivion.” 
White fears that the vast sums of money available to the Christian right and groups such as the tea party (which he sees as an extension of the Christian right) are solidifying institutions from universities to media outlets in the propagation of this culture of hate. White, before he accepted his homosexuality as a gift from God, ghost-wrote autobiographies for Christian-right leaders including Falwell. White and Nixon, knowing that White’s old clients were the primary sources of anti-gay rhetoric, moved to Lynchburg. They set up house across the street from Falwell’s megachurch. They attended services and stood together in silent protest as Falwell delivered anti-gay rants from the pulpit. White watched as Liberty University rose to dominate Lynchburg.
“Liberty University is funded by fundamentalist billionaires, like the man who owns Hobby Lobby, like Chick-fil-A and the fundamentalist author who wrote these terrible books, the ‘Left Behind’ series, Tim LaHaye,” White said. “These guys are giving tens of millions of dollars to institutions such as Liberty. They see the Liberty Universities of the world as the Koch brothers do, as the bastions of training for the new Americans. They are brainwashing young people whom they hope will guide us away from the precipice of liberalism.”
Liberty is one of the fastest-growing universities in America. It has 50,000 students, on campus or taking degrees through online courses. The university built a 24-hour, all-seasons ski resort, the first in the nation. It has an Olympic-size pool and an Olympic-style ice rink. It has an accredited law school. Its debate team often beats major Ivy League teams. It is putting in a medical school. This is also a university that teaches that the oldest fossils date from only 6,000 years ago. It produces Ph.D.s who believe exclusively in creationism, reject evolution and deny that global warming exists. And it is a university that is openly hostile to gays, lesbians, bisexuals and those who are transgender.
“By the time Gary and I moved away from Lynchburg a majority of Virginians seemed to be turning against gay people,” White said. “They passed a constitutional amendment against marriage equality and new laws saying we cannot adopt [children] or provide foster care. More than half the people of Virginia seem to see us as the enemy.”
As the economy unravels, as hundreds of millions of Americans confront the fact that things will not get better, life for those targeted by this culture of hate will become increasingly difficult. Rational debate will prove useless. “Fundamentalists aren’t interested in data,” White said. “They are not influenced by truth, including scientific, psychological, psychiatric or historic truth. They are not influenced by a personal experience with truth. The Bible is more important. Verses are taken out of context to condemn even sons and daughters. How do you oppose that?”
“We have 29 states that do not outlaw discrimination on the basis of sexual orientation,” White said. “Transgender Americans are invariably the worst victims of discrimination and violence. And yet there are 44 states that do not outlaw discrimination on the basis of gender identity. There are 44 states that have laws or constitutional amendments denying us the rights of marriage, claiming our relationships are unholy, that we’re sick and icky,” White said. “And Mr. Obama has just said marriage equality is up to the [individual] states. A majority of the states have already decided against us. If you ask a gay person in New York ‘Can we adopt?’ he will respond of course we can adopt. Can we provide foster care? Of course we can provide foster care. Can we get jobs equally? Of course we can, especially if we are white and male. But with all the progress we have made, 44 states still see us as the enemy. Add a few more states to this list and it is over. How awful it will be if these restrictions make their way to states such as Connecticut, New York and California. Remember, California is going down the tubes financially. And the fear about the nation’s financial future is the engine that drives all of this.”
“Too many of my sisters and brothers in the gay community don’t seem to understand the power of religion,” White lamented. “They have been rejected by religion. They hate the idea of religion. Therefore, they’re not going to deal with religion, which is fatal, because religion is the heart of homophobia. Without religion there would be no homophobia. What other source of homophobia is there but six verses in the Bible? When Bible literalists preach that LGBT people are going to hell they become Christian terrorists. They use fear as their weapon, like all terrorists. They are seeking to deny our religious and civil rights. They threaten to turn our democracy into a fundamentalist theocracy. And if we don’t reverse the trend there is the very real possibility that in the end we will all be governed according to their perverted version of biblical law.”

I reply to an e-mail from one of my mother's best high school girl friends. A recent family update.


Hi Joye,

This is Mark replying to your so very thoughtful e-mail.  Let us just say that Ralph has not yet embraced 20th century computer e-mail technology.  I cut and pasted your e-mail and will leave it on the kitchen table for him to read in the morning.  I know he will be pleased to hear from you and grateful for the Howie Selke update.

We are very sorry to hear about your Aunt Wanda.  She sounds like a very thoughtful lady, what with having made provisions for the books and things.  After Anne died, the job of being the archivist and curator of "stuff" here at 1004 S Grove Avenue either fell unto me, onto me, or I embraced it.  Have found many treasures.  Gave away about 200 books to the Lake Zurich Lions Club for the book sale, at the end of last April.  That cleared up SOME book shelf space.  Opened a couple of very old blanket chests and found a treasure trove of stuffed animals (very high end creatures) that Marianne had accumulated from her childhood days.  Boxed them, wrapped them, and then put them under the Christmas tree as presents from each of her family members (me, dad, Gay, Gay's husband Mike, my son Adam, Gay and Mike's son Scott).  Marianne took them back to Providence, RI, where she now resides.  Looked about her smallish place of residence, and said, "hmm, have no room for MOST of these adorable guys.  Let me go on-line to see if I can find someone who can repair them, clean them up, and then maybe give them away?"  

This she did, and a most beautiful series of e-mail correspondence followed, in which the stuffed animal cleaner / repair craftsperson readily agreed to fix 'em up, AND to find them loving homes, and also agreed to clean up and fix up the THREE (and only three) that were too important for Marianne to part with, all pro bono, of course.  My parents failed to raise any materialists.  We love to give away our good stuff, that we no longer have room for (literal room, and room in our hearts); knowing that they will be placed in excellent, loving homes is more than enough of a reward.

Around September 1, Ralph got sick.  He lost 33 (we debate this, he claims 30) pounds, and shrunk 4" (he refuses to admit this; I can tell the difference).  He had to lose 15 pounds in two weeks before his primary care guy, an internist started to take his situation seriously.  Although Gay suggested to him that many of the symptoms he was enduring were also side affects of the "sleeping pill" perscription the doctor had written for him, Ralph has never been any good at listening to what blood relatives lacking the necessary credentials has to say.  BUT, when his golfing buddy Drew Fletcher sent him an e-mail, saying, "Hey, Ralph, about that sleeping pill you're taking, you exhibit about 75% of the symptoms that are side affects.  Think about stopping that medication."  Which Ralph indeed did do (he gives great credence to the opinions of his golfing buddies, no matter what their credentials are) at which point in time he began to regain his lost weight.  He was so delighted to get to 185.  Not so delighted now to be over 200 (slightly), which is about 5 more pounds than he started from, back when he began to lose the weight.

He also said, and this was within the last 10 days, that, for the first time since his horrifying bout with persistent nagging illness began (basically, he had never been sick a day in his life, except for when he had to have his appendix removed, circa 1970)!  And the absence of illness is a blessing, indeed.

He and I have played golf, since about 15, November, 2011, oh, I'd guess, something like 160 times.  The owner of the course and all the people that worked there were so worried about dad, not having seen him during the month of August, after mom died (there is much paperwork and nonsense that needs to be performed in the aftermath), and then after his 2 1/2 months of illness, that they simply said, "come out and play golf with Mark any time."  The head golf professional at the course, Donny Habjan was the assistant golf pro at Midlothian Country club and used to play with Floyd Ganzer every Saturday morning, so, there is a Blue Island connection.

For me, the opportunity to play golf almost every day with my father for the last 6 1/2 months has been the blessing of a lifetime.  I had forgotten how much I love him, and how much fun we've always had playing golf together.  Of course, I usually beat him now, BUT NOT ALWAYS.  IN January, we were playing, and at the end of nine holes, he had shot 39.  But, it was very cold and windy.  But, I am thinking, "hmm, if he can make 8 bogies and one par on the back nine, he will shoot his age," so I make with him a Faustian bargain:

"Dad, if you will only play the back nine with me, I will NEVER again ask you for anything to do with golf."

Oh, he was so reluctant, but, he loves me, has basically never been able to say "no" to me, about anything to do with playing more golf, and agreed.  Things went pretty much as scripted, EXCEPT, that he had to make 8-foot long snaky putts on each of the last two holes to shoot 44 on the back nine, for, a total of 83.

MY FATHER SHOT HIS AGE!  Ta da!  And then I explained it to him, and went and bragged in the golf shop all about him.

We played the next day, he started with 44 on the front nine.  I was playing brilliantly, and not paying attention to him.  He shot 39 on the back nine.  Shot his age, two days running.  A couple of days later, he shot 41-41, BEAT his age!!!!

And then, about a month ago, he shot 79!!!

AND, he can still drive it past me (when I hit it solid, but very high, into a left to right crossing wind).

I've been seeing a social worker on a regular basis since early February.  She wanted to talk with dad, to make sure (or to see if) his perception of the story of my life and mine seemed to be in consonance.  So I made an appointment for him to talk with her on the phone.

Now, as a medicaid recipient, I can get free transportation (free to me, the state of Illinois medicaid fund pays a LOT of money to transport me) to the mental health site, which is in Berwyn.  SOMEHOW or another, the transportation got messed up (I have to phone in the request at least 48 hours in advance) and Ralph ended up driving me to the site.  I invited him to join me and Diane in the session.  He mostly talked (I was merely a GREEK CHORUS) for about 45 minutes before I shooed him out of the room, and then I looked at Diane, and damn near broke down into tears:  "That's the closest thing he's had to grief counseling since mom died."

It has been my contention that he SHOULD have grief counseling; who in the world is prepared to lose a spouse of 61 1/2 years, who was in good health on Tuesday evening, Wednesday morning, and then dead on Sunday?

Well, the transportation got screwed up again last week (could easily be my fault, I am SO doubtful as to be certain I did not) when I was going to have a buddy of mine come in, and have him tell her about the last 12 or so years that we have known each other (I lived with him at his mom and her husband's home in McHenry last July, before mom died, for about 15 days).  My buddy Steve's step father, however, flew back into Chicago and needed a ride home from O'Hare, so Steve couldn't make it.

And I didn't have a ride, so, the Ralph express was called into action.  And he was good enough (and comfortable enough) to go into Diane's office with me, and THIS time, she didn't talk to him about ME, she talked to him about mom, asking those brutally honest questions that really need to be addressed before you can begin to heal from the loss, but, she does it in such a non-threatening way, that dad, I have no doubt, was entirely unaware that he was having a therapy session.  I did kick him out after 35 minutes, this time (sheesh, I have my own issues) but I also did cry, from gratitude to this wonderful woman who has assessed the needs of our (perhaps perpetually, but only mildly) dysfunctional household most accurately, judges not, but gives us the opportunity to talk about our lives, to get stuff out of our chests, out of our guts, out of our minds, and bring them to the light of day, and the purification of fresh air.

She managed to ask "the big one" about the decision to pull mom from life support.  Dad replied, "when all the doctors and all the nurses tell you the same thing, that EVEN if she should live, she will never have the same quality of life, it is an easy decision to make."

Well, I was with mom when she had the stroke.  I dialed 9-1-1.  I administered mouth-to-mouth resuccitation.  I waited after the paramedics arrived, and it took them 25 minutes to spark her sufficiently back to life.  And while she was in the hospital, although her vital signs were good, she never regained consciousness.  Also, she had double pneumonia, and I knew that her lungs were not getting any air into them.  So, she was with VERY limited oxygen for 31 minutes.   Her brain had virtually no oxygen for 31 minutes.  She would never have regained her faculties for speech, for thought, for writing, for enjoying anything; she would have been vegetative, a thing both mom and dad had decided 20 years ago they did not want to have happen to them.

So, yes, it WAS an easy decision.  One they had addressed before.  Does dad miss mom?  Of course, every day.  But we both keep her alive in our hearts and in our minds.  We talk about her, we tell stories, we reminisce.

Marianne came back to Barrington to work on "Anne's Garden," the memorial garden to Anne (Mike Magliola donated $500 and another good family friend also donated the same amount, to be used for the creation of "Anne's Garden," which sits along the south side of the house, right across from "John's Garden" which mom so lovingly tended from 1988 until 2011).

It was an interesting project.  Dad got all nervous about it (what with his brother-in-law having donated a lot of money, what with Marianne having been tasked with the job of designing / redesigning it, what with it is another thing on a never ending series of check lists that needs to be done, what with dad not knowing jack or squat about gardens, and so, in the three week run up to Marianne's arrival, dad developed a new habit of distracting himself from watching the on-coming traffic on the roads, streets, and highways:  garden scoping).  It used to be that the only time we had to worry about a head on colission with Ralph driving was when we'd pass a golf course,  He'd invariably crane his neck to check the course out, steering ever so predictably into either the right hand lane, if the course was on the left, or the left hand lane if the course was on the right.l  But, there aren't THAT many golf courses around.

THERE ARE, however, many gardens around.  Most everybody has one, and some of them are simply magnificent, some are endearingly subtle, so, now dad, who has tasked the garden's creation out to Marianne is starting to think about what might be done, speculate on how much it might cost to do it, and begin worrying about a new unstarted project, over which he had virtually no control, no expertise, and a whole lot of uncertainty.  His golf game died and descended into hell.  It was painful to play with him.  He was so distracted.  And it took me a LONG time to figure out just what the issue was.  ACTUALLY, since I started out-driving him by lots of yards, I made the more convenient and satisfying assumption that now I was hitting the ball 60 yards father (it was actually more like 15-40 yards farther, mostly 15).  But, in retrospect, it was the garden; another unfinished project, hanging over his head, like the sword of Damascles.

So, Marianne's first day here, dad took her all over, showing her the gardens he admired the most.

Second day, they broke soil.  It was fairly brutal.  Mom had these yucca plants that she loved (and dad hated).  Yucca plants will over take your garden, and these had succeeded in taking over the spot.  It was all weeds and over growth.  But, for ripping up over growth, and turning soil, well, Ralph has some skills in this arena, having done so for mom for many years.  The yucca had strong, thick, resistant root, about a foot below land level.  So, they dug, and the macheted, and cut.

Mom, watching all this from heaven above, decides to send a reminder to Marianne about how much she loved the yuccas, and so, Marianne gets attacked by tiny biting black ants (their bigger counterparts have been invading the home for the last 3 months; we squish, they continue to breed and conquer), and then comes into contact with the sole strand of poison ivy in the yard.  She is VERY much sensitive to poison ivy.  She gets it.  "Right mom, I know.  You love the yuccas.  We will leave the six on the ends, but these middle guys HAD to go!"

Marianne then goes to visit Gay and Mike (and my son Adam, who lives with his aunt and uncle).  Stays over night, then goes to a plant place.  Calls dad, tells him she is at the plant place.  Dad suggests she buy some plants.  "I already have, dad," she replies.

And then Marianne simply took over, a veritable force of nature.  She had no time to do itern training and supervise.  She just kicked Ralph out of the garden, relieved him of all digging, pulling, plant-learning responsibilities.  And she stuck at it, about 10 hours a day for the last 4 days.  We didn't rebuild the garden.  It was quite enough of a project to clean out and dig up and put down the peat and new top soil, plant the sun plants (Marianne had never had a sun garden before; having one now changed all her pre-conceived notions about which flowers should be planted), show off the garden to three of my best and dearest friends (one of them, a green thumb, and, while not quite a golfing buddy of dad's, at least a peer male, who also is THEIR household's DG (designated gardener) to give dad the advice, "Water the hell out of it."  And this dad doth do (or at least has been doing, most regularly).

I've lost (misplaced here in the computer room) our digital camera, but my sister Gay came out the other day and took some photos of the garden. When (and or if) these are made available to me (she DID promise to send me an e-mail), I will pass the photos along to you.

Marianne's efforts were well worth it.  We ended up with a much smaller scoped projected than original thoughts had indicated.  Everything always takes longer than you think.  It was the perfect plan; the perfect garden.  It is the perfect plan; it is the perfect garden.  And now I've had it re-inforced, that, LESS IS MORE!

We are blessed; blessed to have such wonderful friends, blessed to have our health (back, finally); blessed to have things which hold our interest; blessed by people who find the time to give of themselves; blessed with long time friends, who remember a lot of things, and know a lot about us.

Thank you for having been the blessing in Anne's life that you were; for being her good and very dear friend.  Thank you for making the time to take the time to write.  It is in those small (but oh so large) things that we do, to let those we know know how much we love them, and still care, and still carry them in our hearts, that we most delight the Lord.

May good health, peace, and blessings be upon you, and also upon all of them that you love, and also upon all of them that love you.

At least two-thirds of the U.S. senators drafting new financial regulations hold stock in banks or other companies affected by the legislation, such as Citigroup Inc. and Wells Fargo & Co., disclosure statements show.” (Bloomberg, June 16, 2010). But the final explanation is that politicians have acquired the automatic habit of prostrating themselves before those with vast sums of money. And this is one more of the many toxic byproducts of the growing inequality in wealth: a sense of community is increasingly destroyed, along with the moral values that hold it together. We are left with two opposing classes that inhabit two opposing worlds, and their clash is inevitable.

Bankers and Forgiveness

When homeowners have fallen behind in their mortgage payments, whether because of a job loss or because the interest rates just shot up, the bankers have responded coldly. Led by their economic interests, they set their robo-signers working overtime on foreclosures, forcing millions of people out of their homes. Back during the height of this current economic crisis, when Congress considered passing legislation that would have allowed judges to lower home loans in order to prevent these foreclosures, the banks lobbied furiously and killed the legislation.

But when the bankers themselves commit their own transgressions — not innocent and unavoidable transgressions like not paying back a loan because you lost your job thanks to the bankers’ recession — but actually breaking the law, the government not only forgives them, it virtually becomes an accomplice in their crimes.

Robo-signing, for example, is a crime. It occurred when bank employees signed thousands of documents, claiming they were accurate, without bothering to verify their claim. Yet no one went to jail.

In a recent New York Times article, Jesse Eisinger pointed out that the JPMorgan scandal has raised an array of questions:
 “What did Jamie Dimon, JPMorgan’s chief executive, and Doug Braunstein, the chief financial officer, know, and when did they know it? Were the bank’s first-quarter earnings accurate? Were top JPMorgan officials misleading when they discussed the chief investment office’s investments? … The first question on everyone’s mind should be whether any existing laws were broken.” (May 17, 2012).
However, Eisinger was quick to point out in relation to the last question: “That it hasn’t been asked shows how little true accountability there has been since the financial crisis. No top-tier banker has gone to prison for the many bank failures, the deceptive sales practices or the misrepresentations of the books.”

The laws for the 1 percent are treated by the government as if they were humble requests — nothing to be seriously enforced if the 1 percent decline to accept. The laws for the 99 percent are brutally enforced, not to mention the prevalent police brutality that occurs without any legal justification.

Back in 2011, Gretchen Morgenson and Louise Story, in another New York Times article (July 7, 2011), reported federal prosecutors adopted a gentler code for bankers:
“Federal prosecutors officially adopted new guidelines about charging corporations with crimes — a softer approach that, longtime white-collar lawyers and former federal prosecutors say, helps explain the dearth of criminal cases despite a raft of inquiries into the financial crisis. … The guidelines left open a possibility other than guilty or not guilty, giving leniency often if companies investigated and reported their own wrongdoing. In return, the government could enter into agreements to delay or cancel the prosecution if the companies promised to change their behavior.”
More recently, Gretchen Morgenson has reported that a prominent Wall Street analyst and others suspect that “insider trading can and does occur regularly at many Wall Street firms. In their view it has become institutionalized…. Those in the know can get rich before the rest of us know what happened.” (The New York Times, May 20, 2012).
And this failure of the Securities and Exchange Commission (S.E.C.) to prosecute these cases comes on the heels of its spectacular failure to indict Bernard Madoff, even after being presented with overwhelming evidence of his guilt.

Although the financial industry is the recipient of the bulk of the government mercy, perhaps because it is responsible for the bulk of the crimes, the corporate world in general is a lucrative beneficiary. In the wake of the recent Wal-Mart Mexican bribery scandal, The New York Times (April 27, 2012), reported that, even though bribery of foreign officials is a crime, if past practice is any indication, no one will be prosecuted.
The prominent example of past practice mentioned in the article was Tyson Foods. After listing a series of crimes committed by Tyson executives, the article concluded:
“It’s axiomatic that people, not corporations, commit crimes. So what happened to the Tyson executives involved? Not only did the Justice Department and the Securities and Exchange Commission take no action against them, but the executives involved weren’t even named.” (The New York Times, April 27, 2012).
Why is the government so intent on pursuing a double standard when it comes to enforcing the law on the 1 percent and on the rest of us? In part this mundane corruption is due to the cozy relation that has been cultivated between the politicians and the corporate world. If a politician or regulator plays the game and pleases the corporations, they can look forward to a financially rewarding career in the private sector after they leave office. Politicians, for example, routinely become lobbyists.

The corruption is also due to this fact: “At least two-thirds of the U.S. senators drafting new financial regulations hold stock in banks or other companies affected by the legislation, such as Citigroup Inc. and Wells Fargo & Co., disclosure statements show.” (Bloomberg, June 16, 2010).
But the final explanation is that politicians have acquired the automatic habit of prostrating themselves before those with vast sums of money. And this is one more of the many toxic byproducts of the growing inequality in wealth: a sense of community is increasingly destroyed, along with the moral values that hold it together. We are left with two opposing classes that inhabit two opposing worlds, and their clash is inevitable.

It’s Back to 1980, With the JCS Auctioning Off the Presidency From the Pentagon Battlements

Let me whisk you to 1980 on one of Obama’s miracle drones.
In the right-center we had incumbent President Jimmy Carter, derided as a man of peace, el wimpo.
True his top foreign policy man was an unreconstructed Polish cold war warrior burning to bringing the  Soviet Union to its knees. True, the two  had launched the largest covert operation in the CIA’s history — $3.5 billion – against the Soviets in Afghanistan.
True he was financing Argentinian torturers to impart their skills to the Nicaraguan contras.
True, his out-year military budgets actually outstripped those of his opponent.
On the far right was Ronald Reagan, his candidacy crowning almost a decade’s worth of propaganda for the New Cold War from outfits such as Paul Nitze’s Committee on the Present Danger. Nitze used to go on speaking tours with a rack of missiles. On one side were America’s trim little ICBMs, on the other, their mighty, albeit technically somewhat backward Soviet  counterparts.
The Reaganites derided all treaties as traps, depicting Uncle Sam as, in military terms, down to his underwear, with a peashooter in his holster. Every Pentagon wish received a cordial welcome.
Here we are today. On our center-right , Obama, derided as a man of peace, el wimpo, though his relations with the Pentagon have been intimate, and he himself ductile to their demands.
True, he’s been waging war on… how many fronts? Five, six, with probably more on a covert, semi-privatized basis.  True, he has given the finger to all positive developments in Latin America, presided over a bloody coup in Central America.
True, he has been Israel’s serf, and has thumped the drum against China and Russia.
True, his secretary of state has been a fountain of bellicose bully swaggering.
And on the far right here’s Romney. The Pentagon auctioneers await the next bid. Up goes Romney’s paddle.
Make your pitch, shout down the Joint Chiefs. Romney reads them extracts from his latest speech, delivered in response to Obama’s in Chicago at the NATO summit.
“Last year, President Obama signed into law a budget scheme that threatens to saddle the U.S. military with nearly $1 trillion in cuts over the next 10 years. President Obama’s own defense secretary, Leon Panetta, has called cuts of this magnitude ‘devastating’ to our national security. Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, has plainly said that such a reduction means ‘we would not any longer be a global power.’..
“We have a military inventory composed of weapons designed 40 to 50 years ago. The average age of our tanker aircraft is 47 years, of strategic bombers 34 years. Our Air Force, which had 82 fighter squadrons at the end of the Cold War, has been reduced to 39 today. The U.S. Navy, at 285 ships, is at levels not seen since 1916. Should our air, naval and ground forces continue to age and shrink, it will place the interests of the U.S. and our friends and allies at risk.
“An alliance not undergirded by military strength and U.S. leadership may soon become an alliance in name only.
“In 2009, the Obama administration stunned two NATO allies — Poland and the Czech Republic — with a surprise withdrawal from an agreement to station missile defense sites on their territories, an agreement they signed in the face of Russian threats. Two of our most valuable partners were treated shabbily, the cause of missile defense was set back, and the Russians achieved a prime security objective without having to make meaningful concessions in return. And President Obama recently promised Russian leaders even more ‘flexibility’ on missile defense if they give him ‘space’ before his ‘last election.’
“At this moment of both opportunities and perils — an Iranian regime with nuclear ambitions, an unpredictable North Korea, a revanchist Russia, a China spending furiously on its own military, to name but a few of the major challenges looming before us — the NATO alliance must retain the capacity to act.”
So the bidding war will go, and who would wager that the Pentagon chiefs won’t deem Romney the safer bet?
Ironically, the Law of the Sea is once again up for ratification by the US, a lonely hold-out, though the Treaty has been part of international law for many years. One of the big guns in the first Reagan campaign was this same law. Starting in the mid 1970s William Safire wrote scores of columns against the law then under negotiation, and was still at it in 1994: A specimen from the late 1970s:
“Seven years ago, in a foreign blunder of the Nixon administration, we agreed to a Law of the Sea Conference… The State Department wanted to show the Third World that we wanted them to get rich at little cost to us. The sop that we were planning to give the Third World’s  Cerberus was a division of the minerals of the ocean bottom. Potato-like lumps called ‘nodules’ litter the ocean bed, containing manganese, copper, cobalt. Plenty of nodules for everybody.  The deal we offered was to take half the natural common and turn it into a Third World cartel, leaving only the other half to the entrepreneurs that Locke called ‘all mankind.’”
Only half! You can imagine the sport Reagan  had with that on the campaign rail.
Now the Obama administration is trying to push ratification through again. Fat chance. They already put the vote off till after the election.
The cold war never went away. Romney howls for “anti”-missile encirclement of Russia from Georgia, Poland and the Czech Republic. Jackson-Vanik, passed in 1974, which denies Russia most favored nation status (given the Chinese some time ago) on human rights grounds is still on the books for Russia and has to be over-ridden on a case-by-case waiver process. As with Law of the Sea the Republican ultra-ultras in the Senate are implacably opposed.
A final note on NATO. There were gale-force gusts of bombast in Chicago about the NATO Alliance’s historic role as freedom’s buckler, starting with the defense of Europe, thus perpetuating nearly 70 years of years of humbug. There was never the slightest chance of the Soviet Union and its auxiliaries in the Warsaw Pact rolling west in the prospective onslaught luridly evoked  by Winston Churchill in a speech at the Massachusetts Institute of Technology in March, 1949. Churchill raised the specter of the “Mongol hordes” that had menaced Europe 700 years before, only heading home when the Great Khan died. “They never returned,” rumbled the old faker, “until now.”
Having borne almost the entire burden of crushing Hitler’s armies on the Eastern front and having suffered appalling casualties in so doing, the Soviet Union was in no condition to invade western Europe. This didn’t impede mad Western scenarios of the sort that threat-inflators routinely issued down the decades until the very moment the Soviet Union collapsed.
Driven by Truman’s 1948 arms scare, NATO lumbered into being in 1949, ratifying dominance of US arms procurement for the alliance, internal custodial sentry duty against any slide to the left by one or other of the European allies, establishment of West Germany as an independent state and US control of the nuclear forces deemed necessary to counter non-existent Soviet conventional superiority.
Year upon year nothing dented the endless flow of “threat assessments” powering new weapons systems, “theater nuclear” and “counterforce” doctrines that kept the arms factories running at full tilt and spawned a vast subculture of think-tanks, expert panels and lobbyshops.
Then, suddenly, it was all over. NATO’s formal purpose evaporated. The Soviet Union collapsed. Without delay NATO burgeoned into exactly what its left detractors had always said its essential function had been from the very start, a US-dominated political and military alliance aimed at encircling Russia and acting as enforcer for larger US imperial strategy. NATO’s onslaughts on the former Yugoslavia duly followed.
NATO doesn’t need a new mission. It needs to disappear into the trashcan of history along with the cold war that engendered it.

WEST BEND - The father of a three-year-old girl found dead in a West Bend apartment building tells TODAY'S TMJ4 he is in shock and grieving after her death.
He said to TODAY'S TMJ4's Nick Montes that Haley Kluwe died.  Autopsy results were expected Wednesday afternoon.
Authorities in West Bend confirm they are conducting an investigation into a girl's death.
According to a statement from the police department, the girl died inside an apartment building on Barton Avenue in West Bend.
Police did not initially confirm her identity.  They are trying to find clues as to how the toddler may have died.
A brief police report made no reference to any suspect or arrest, and authorities did not answer questions about any suspects in the case.  We know the girl's grandmother was on scene when she died.

Haley Kluwe returned to mother, 

found dead three months later

WEST BEND-As more and more family members speak out, we are left to try and piece together what exactly happened to three year old Haley Kluwe.

Haley was found dead in a West Bend Apartment Tuesday.

Police say there were signs of abuse and neglect, marks on her face and body.

They also say her twin sister and older sister looked neglected.

Formal charges are pending against her mother and boyfriend.

But several family members say they objected to having Haley returned to her mother after her maternal grandfather and his wife (pictured above) had raised the girl and her sisters for most of their lives.

An aunt by marriage tells CBS 58 that the return to the mother happened in January after the grandfather's wife died from cancer.

The same source says Haley missed a February appointment with the surgeon who had successfully removed a brain tumor from Haley while in her grandparents' care.

This same caregiver says she phoned in a complaint with Washington County Social Services in March, but never heard back.

On Friday, the director of Human Services sent CBS 58 Anchor Michele McCormack the following email:

"I am sorry for not getting back to you, but given the situation, I have spent little if any time in my office in the past couple of days.

As you are aware I cannot give any comment.

Jim Strachota
Human Services Director"

McCormack made several phone calls and emails both to county and state officials Tuesday evening when family members began contacting her to say their concerns were ignored.

Privacy laws make it difficult to get a complete picture.

Right now on the Wisconisn Department of Children and Families website they have posted what they are bound to legally. It reads:

The Division of Safety and Permanence (DSP) has received notification that a child death, serious injury or egregious incident has occurred and maltreatment is suspected, or that a child placed in out-of-home care has died and suicide is suspected.

WEST BEND-The mother of a toddler found dead on Tuesday had a bail hearing Thursday along with her boyfriend.

24 year old Leanne Leszysnki and her boyfriend 24 year old Justin Streicher were taken into custody when authorities did a welfare check based on a call from a doctor's office expressing concern about three year old Haley Kluwe and her two sisters.

Officers found Haley dead and said her twin sister and older sister appeared to be in need of medical attention as well.

The judge found probable cause that the two suspects committed serious felonies including physical abuse of a child, possible homicide, and drug offenses.

Bond was set at $10,000 cash each.







Shocking allegations in West Bend toddler death 
New details released in child neglect case 

UPDATED 8:19 AM CDT May 11, 2012 

A West Bend mother and her boyfriend are now charged in the death of the woman's three-year-old daughter. 

Leann Leszynski, 25, and Justin Streicher, 24, are facing more than 35 years in prison if convicted of charges of child neglect resulting in death, maintaining a drug trafficking place and possession of narcotics. 

In a criminal complaint released in court Thursday, police said they found Haley Kluwe dead on a mattress inside her mother's apartment at 2113 Barton Ave. on May 1. 

Investigators said they had received a call from Leszynski's doctor's office concerned for the girl, after Leszynski had told them she couldn't pick up a prescription in person because her daughter was dead in her apartment. 

According to the documents, when police arrived Leszynski told them a picture had fallen from the wall and hit her daughter in the face a few days prior. She said the bruising was bad but she didn't want to get help because she feared she would be accused of abuse. 

The medical examiners report also said Haley had a cut on her finger that had become infected and turned into a flesh eating bacteria. They said the infection could have contributed to her death. 

Leszynski's family members said they're trying to support her but the details of this case are shocking. 

"Coming from family and family comes first, the people that your closest too sometimes, you don't think they're capable of those things even if they say they are," said Brandon Hurst, cousin of Leszynski. 

The criminal complaint also alleges Leszynski and Streicher of using cocaine, heroin and pot and selling it out of their apartment. Witnesses told police Streicher would blow marijuana smoke in Haley and her two sister's faces to make them go to sleep and locked them in a closet while handcuffed when they were loud. The other two children were removed and are in protective custody.
